Chief Justice Gertrude Torkonoo Given 10 Days To Respond To Removal Petitions

President John Dramani Mahama has given Chief Justice Gertrude Torkonoo ten days to submit a preliminary response to three petitions calling for her removal from office.

This directive follows a formal request made by Justice Torkonoo to receive copies of the petitions filed against her. In response, President Mahama’s office stated:

“Accordingly, you are respectfully requested to submit your preliminary response to the petitions within ten (10) days of receipt of this letter to facilitate further consultation between His Excellency and the Council of State.”

President Mahama also expressed disappointment over the public circulation of Justice Torkonoo’s letter requesting copies of the petitions. Reports indicate that her letter was widely shared on social media even before the President had reviewed its contents.

The President’s response noted:

“His Excellency, however, notes with disappointment that your letter of 27th March 2025 addressed to him was circulating on social media even before he could review its contents.”

The letter was reportedly attached to another correspondence sent to the President of the Supreme Court, the President of the Association of Magistrates and Judges, and the President of the Ghana Bar Association (GBA).

The three petitions calling for Justice Torkonoo’s removal have sparked intense debate within legal and political circles. While the specific allegations against her remain undisclosed, the case has drawn significant public and legal scrutiny.

Under Article 146 of the 1992 Constitution, a Chief Justice may be removed for stated misbehavior, incompetence, or incapacity due to infirmity. If the petitions proceed, the President will appoint a committee to investigate the claims.

Legal analysts argue that Justice Torkonoo’s response within the 10-day timeframe will be crucial in determining the next steps. If her response does not sufficiently address the concerns raised, a formal inquiry could be initiated.

With this development, Ghana’s judicial and political landscape now awaits a critical decision that could impact the leadership of the country’s highest court.
