Prominent Ghanaian legal luminary, Kwaku Ansa-Asare, has made a bold prediction regarding the fate of suspended Chief Justice Gertrude Torkornoo, stating that her removal from office is inevitable. Speaking in an interview with Woezor TV, shared on X (formerly Twitter) on April 25, 2025, Ansa-Asare remarked that based on the evidence and political climate surrounding the situation, Justice Torkornoo will not retain her position.

"Without mincing words, I think the CJ will not come out well at all. Having regard to what is going on, the writing is on the wall — the CJ will be removed," he stated firmly.

Justice Torkornoo was suspended earlier this year after President John Dramani Mahama, in consultation with the Council of State, determined that there was a prima facie case for her removal based on three separate petitions submitted by concerned individuals and groups.

The allegations against her are serious and wide-ranging:

  1. Breaching the 1992 Constitution:
    The first petition, submitted by a group known as the Shining Stars of Ghana, accuses the Chief Justice of violating constitutional principles. This allegation stems from her controversial ruling in a case involving Minority Leader Alexander Kwamina Afenyo-Markin and the Speaker of Parliament, Alban Bagbin, concerning the declaration of four Parliamentary seats as vacant.

  2. Misappropriation of Public Funds:
    In the second petition filed by private citizen Daniel Ofori, Justice Torkornoo is accused of misappropriating GH¢261,890 and US$30,000 during official foreign travels in 2023. According to Ofori, she improperly used Judicial Service funds to cover private travel expenses for herself, her husband, and her daughter—individuals who were not entitled to public funding for such trips.

  3. Abuse of Judicial Power:
    The third petition was filed by Assistant Commissioner of Police (ACP) Ayamga Yakubu Akolgo (Esq.), who alleges that the Chief Justice wrongfully orchestrated his arrest and detention. ACP Akolgo claims that the arrest was capricious, unjustified, and an abuse of the sacred judicial office, leading to pain, trauma, and a violation of his fundamental rights.

With an independent investigative committee now reviewing these allegations, political and legal watchers across Ghana are closely monitoring the developments. For Kwaku Ansa-Asare, a seasoned observer of Ghana’s legal landscape, the outcome seems clear.

"I don't think I would be doing any credit to myself if, after observing the landscape, I still maintained that the Chief Justice would come out clean and therefore keep her job. I don't think so," Ansa-Asare emphasized.

 

As public interest surges, the case could lead to one of the most consequential judicial shake-ups in Ghana’s Fourth Republic, further fueling debates about accountability at the highest levels of governance.
